  1. This Original Application has been filed by the applicant who claims to be the legally wedded wife of the deceased employee Shri Nonelal Naahar.

  2. Annexure A-1, which is the nomination for family pension shows that the applicant is described as wife and four others are shown as the unmarried daughters of the deceased employee.

  3. The applicant contends that the retiral benefits are not disbursed to her on the ground that the private respondent No.3 also claims to be wife of the deceased. An order (Annexure A-2) was passed by the Civil Court granting succession certificate in favour of the applicant and so based on this, the respondents should disburse retiral benefits, the applicant contends.
