  1. The present appeal filed by Shri Varun Dhiman against Institute of Chartered Accountants of India (ICAI) was taken up for hearing on 04.07.2013 when the Respondents were present through Shri N.P. Singh, Sr. J.S., Ms. Seema Gerotra, Deputy Director and Ms. Veena Dutta, Asstt. Secy. The Appellant, however, chose not to be present.

    Facts of the case:

    The Appellant filed his RTI application dated 19.03.2012 with the CPIO, ICAI, New Delhi seeking following information:

    ...attested/certified/true copies of Answer Sheets of Group I containing Papers: Accounting, Business Laws, Ethics and Communication, Cost Accounting & Financial Management and Taxation

    And

    Group II containing Papers: Advanced Accounting, Auditing and Assurance And Information Technology and Strategic Management.

  2. The CPIO, vide her letter dated 12.03.2012, informed the Appellant that "the supply of answer books is dealt with in terms of the procedure evolved for providing inspection/certified copies of evaluated answer books to the concerned examinees subsequent to the judgment of Hon'ble Supreme Court in the matter of CBSE and Anr. Vs. Aditya Bandopadhyay & Ors (Civil Appeal No. 6454 of 2011) and other connected matters." The CPIO provided a copy of procedure to the Appellant in this regard.

The Appellant, in the meanwhile also filed a complaint before the Commission, acting on which the Commission passed an order dated 15.06.2012 wherein, it, while observing that the Appellant had not availed the first appellate channel as given in section 19(1) of the RTI Act, advised the Appellant to file his first appeal before the Appellate Authority. The Appellate Authority was also directed to dispose of the Appellant's first appeal through speaking order.

  4. The Appellant thereafter filed an appeal dated 18.06.2012 before the Appellate Authority which the Appellate Authority decided vide his order dated 03.07.2012 upholding the reply of the CPIO.
