Background:

1. Shri Rajendra Prasad, President, Rashtriya Bhrashtachar Unmoolan Samity, Shamim Manzil, Islhampur, Mughalsarai, Chandauli, had filed an appeal with the Central information Commission wherein he stated that the names of the Public information Officer and Assistant Public information Officer have not been exhibited on the notice board of Divisional Office, East Central Railway Mughal Sarai, even though the Complainant claimed that two officers were designated for the posts. The Complainant also alleged that not a single application or appeal had been finalized at the level of the Divisional Public Information Officer since 15 October 2005 to 31 May 2006. The Complainant requested the Central information Commission to impose penalty on the officers of the East Central Railway.

2. The Central information Commission called for the comments of the PIO, East Central Railway, Mughalsarai, on 12 September 2006. In his comments, the PIO, East Central Railway, stated the Complainant had sought information regarding finalization of tender for various zonal work under Sr. Divisional Engineer, East Central Railway. The Complainant had informed vide their letter dated 11 July 2006 that he would be apprised the facts immediately as and when information was received from the Divisional Civil Engineering Department. The information was supplied to the Complainant on 21 September 2006.

3. The case was fixed for hearing on 3 January 2007.
