Maharashtra Accounts and Local Fund Accounts, Group C Services Departmental Examination Rules, 2012

No. Pariksha. 2008/C.R 95(Part-II)/Kosha. (Prasha-3).-In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, and in supersession of all existing rules, orders or instruments made in this behalf, the Governor of Maharashtra is hereby pleased to make the following rules regulating the Departmental Examination of the employees recruited in Accounts and Treasuries, Group C and Local Fund Accounts, Group-C Services, under the Finance Department of the Government of Maharashtra, namely:-

1. These rules may be called the "Maharashtra Accounts and Local Fund Accounts, Group C Services Departmental Examination Rules, 2012".

2. In these rules, unless the context requires otherwise,-

(a) "Government" means the Government of Maharashtra;

(b) "Director" means the Director of Accounts and Treasuries, Maharashtra State, Mumbai;

(c) "Appendix" means Appendix Appended to these rules;

(d) "Examination" means the Departmental Examination prescribed under these rules;

(e) "existing rules" means the rules in force regarding the post recruitment examination for Clerk-cum- Typist or Cashir or Lower Division Clerk or Junior Clerk and the rules in force for the Maharashtra Accounts Clerk examination for Senior Clerk or Noting Assistant or Store Verifier or Cashier and Upper Division Clerk or Junior Auditor or District Gram Panchayat Sub-Auditor, immediately before the commencement of these rules;

(f) "Employee in Group C Services" means the person appointed on the post of Accounts Clerk, Junior Account and Senior Accountant as per Accounts and Treasures Group-C Service (Recruitment) Rules, 2008, and the person appointed on the post of Audit Clerk, Junior Auditor and Senior Auditor as per Local Fund Accounts Group-C Service (Requirment) Rules, 2008 by nomination promotion;

(g) "Secondary School Certificate Examination" means the Secondary School Certificate Examination conducted by a Divisional Board under the Maharashtra Secondary and Higher Secondary Education Boards Act, 1965 (Mah XLI of 1965) and includes any other examination declared by Government to be equivalent thereto.

3. Eligibility for Examination.-

(a) An employee appointed in the cadre of Accounts Clerk and Junior Accountant in Accounts and Treasuries, Group C Service and Audit Clerk and Junior Auditor in Local Fund Accounts, Group C Service, shall be eligible to appear for the Maharashtra Accounts and Local Fund Accounts, Group C Services Departmental Examination; or

(b) Accounts Clerk in Accounts and Treasuries, Group C Service and Audit Clerk in Local Fund Accounts, Group C Service, appointed by promotion or nomination, shall be eligible to appear for Part I of the examination; or

(c) Junior Account in Accounts and Treasures, Group C Service and Junior Auditor in Local Fund Accounts, Group C Service, appointed by nomination, shall be eligible to appear for Part I and Part II of the examination; or

(d) Junior Accountant in Accounts and Treasuries, Group C Service and Junior Auditor in Local Fund Accounts, Group C Service, appointed by promotion, shall be eligible to appear for Part II of the examination; or

(e) The Accounts Clerk and Audit Clerk who have passed Part I of the examination and completed two years of regular service on that post shall be eligible to appear for the Part II of the examination; or

(f) The Government employees of other Departments who have passed the Seconday School Certificate Examination or any other examination declared by Government to be equivalent thereto can appear for Part II of the examination on optional basis. However, due to passing of the examination, they will not be eligible for recruitment or any other benifit with reference to Accounts and Treasuries, Group C Service of Local Fund Accounts, Group C Service.

4. Syllabus for the Examination.-

(a) The Syllabus for the exmination shall be as per 'Appendix' to these rules. The examination will be with books or without books as mentioned against each subject in the Appendix. The examination shall be held in part-I and Part-II as per the Appendix;

(b) The syllabus and Marks for the examination shall be as per the 'Appendix' or as prescribed by the Government, from time to time.

5. Period and number of chances for passing examination.-

(i) It shall be compulsory to pass Part-I and part II of the examination within the period of consecutive 3 chances for each part for junior Accountant and Junior Auditor appointed to the post by nomination or promotion, respectively from the date of their appointment. Junior Accountant and Junior Auditor appointed by nomination can appear for both parts of the examination together at the same time or each part of the examination separately;

(ii) It shall be compulsory to pass Part-I of the examination within the period of consecutive 3 chances for Accounts Clerk and Audit Clerk appointed to the post by nomination or promotion, respectively. The employee may also avail chances for appearing the examination thereafter;

(iii) However, the action shall be taken as mentioned in rule 6 in case of failure to pass the examination within prescribed period as mentioned in (1) and (2) above;

(iv) After becoming eligible to appear for Part II of the examination as per provided in sub-rule (e) of rule 3, the Accounts Clerk or Audit Clerk may avail maximum six chances to pass part II of the examination on optional basis;

(v) The employees of other Departments appearing for the examination on optional basis may avail maximum six chances for each part;

(vi) If the candidate appearing for the examination on compulsory and on optional basis remain absent, his/her chance will be counted.

6. Consequences of failure to pass the examination:-

Junior Accountant or Junior Auditor and Accounts Clerk or Audit Clerk, for whom the examination is compulsory, fails to pass the examination within the time-limit and chances prescribed in rule 5, shall face the following consequences,-

(i) Candidate shall not be confirmed to the post of Junior Accountant or Junior Auditor or Accounts Clerk or Auditor Clerk, as the case may be, till he passes the examination...
