Order:

  1. This appeal is by the complainant, aggrieved by the order dated 19.5.2015, passed by District Consumer Disputes Redressal Forum, Indore in CC No. 710/11 dismissing his complaint. The brief facts of the case are that the appellant was the owner of a Bajaj Pulsar Motorcycle, which was insured with the respondent-Insurance Company. The Motorcycle was stolen on 16.11.2010. According to appellant, he gave oral information to the Insurance Co. and its Agent, who advised him to lodge a FIR. The FIR was filed on 20.11.2010, there after when he contacted the officers of Insurance Company they demanded registration card. He got the registration card on 10.12.2010 only. The Insurance Co. repudiated his claim on the ground of delay intimation, as there is 24 days in informing about the theft of the vehicle.

  2. The respondent Insurance Company state that they received information on 11.12.2010, 24 days after the theft. The claim was repudiated on 8.3.2011 on the ground of the breach of policy conditions.

  3. The District Forum dismissed the complaint on the ground of delayed intimation.

  4. Heard.

  5. Documents filed on record show that the police were informed of the theft on 20.11.2010, after 4 days. Though the appellant has stated that he gave oral information to the respondent Insurance Company but as per policy conditions he has to give information in writing, which he has given after 24...
