Grounds of appeal:

1. The appellant has filed two appeals against the decisions of the Appellate Authorities of Punjab National Bank, Patna and the Head Office, New Delhi. He has asked for certified copies of Personal Assessment Forms (PAFs) submitted by a large number of his colleagues, who are identified in his application. He has also asked for such details as interview sheets, observations/recommendations of various committees for promotion/non-promotion of staff, and other related matters indicating as to others have been promoted and why he has been discriminated against in the matter of promotion.

2. The appellate authority has contended that the information/documents sought for are available with the Bank in its fiduciary relationship (i.e. employer-employee relationship) and the disclosure of which is exempted Under Section 8(1)(e) of the RTI Act, 2005. Also, the exercise of performance appraisal is treated confidential. It cannot be disclosed therefore.

3. The appellant has asked for the documents that relate to performance appraisal of the staff, which form the basis for promotion in higher grade. The appellant has stated that he has been denied promotion while his other colleagues despite their dubious credentials have been promoted. Therefore, he would like to examine their performance appraisal forms and the criteria adopted for their promotions.

4. The Personal Assessment Forms submitted by the staff to the employer in fiduciary relationships cannot be shared, as it also does not relate to any public activity by the Bank. Likewise, the views recorded in...
