  1. Applicant is the widow of the late Shri E.K. Ravi who was working under the respondents as GDS MD, Koduveli. Though applicant submitted a request for appointment on compassionate grounds the same was rejected by the respondents vide Annexures A1 and A2 orders. In Annexure A2 order it is stated by respondent No. 3 that applicant had secured only 43 relative merit points and that the criterion followed for adjudging 'hard and deserving cases' is cases with total relative merit points over and above 50 points. The applicant is aggrieved by the aforesaid decisions of the respondents mainly on the ground that Annexures A1 and A2 decisions were taken subsequent to Annexure A11 revised scheme modifying the relative merit points for considering the engagement of the dependent of the deceased GDS on compassionate grounds.

Learned counsel for the applicant submitted that as per Annexure A11, as against the 15 points 20 grace points would be allowed to the widow applicants over and above the merit points for the other attributes. He further submitted that the threshold for 'hard and deserving cases' has been stipulated as 36 points replacing the earlier requirement of 51 points. According to the learned counsel had the respondents taken note of Annexure A11 while passing the impugned Annexures A1 and A2 orders, the applicant would have secured more merit points and she would have been within...
