Sri Krishnadevaraya University Act, 1981

Preamble

An Act to establish and incorporate a Teaching University in the State of Andhra Pradesh and to provide for matters connected therewith or incidental thereto.

Be it enacted by the Legislature of the State of Andhra Pradesh in the Thirty-second year of the Republic of India as follows:-

Section 1 - Short title and commencement

(1) This Act may be called Sri Krishnadevaraya University Act, 1981.

(2) It shall be deemed to have come into force on the 28th July, 1981.

Section 2 - Definitions

In this Act, and in all statutes ordinances and regulations made thereunder, unless the context otherwise requires,-

(1) "academic year" means a period of twelve months commencing on the 1st day of July of the year or such other period of twelve months beginning on such date as the Syndicate may specify in respect of all the colleges under the control of the University or any particular college thereof;

(2) "autonomous college" means a college on which the status of autonomy has been conferred by the University;

(3) "college" means a college established and maintained by, associated with, or recognised by the University;

(4) "department" means a department of studies of the University recognised as such by the statutes and includes a Centre of Studies;

(5) "Director of Higher Education" includes a Joint Director-in-charge of Higher Education;

(6) "employee" means any person appointed by the University, and includes teachers and other staff of the University;

(7) "faculties" means the faculties of the University as prescribed by the statutes;

(8) "Government" means the State Government;

(9) "hostel" means a unit of residence or corporate life for the students of the University, college or institution, provided, maintained or recognised by the University;

(10) "institution" means an academic institution, not being a college, maintained or recognised by the University;

(11) "prescribed" means prescribed by the statutes, ordinances or regulations;

(12) "principal" means the head of a college or an institution;

(13) "recognised college" or "recognised institution" means respectively a college or an institution of higher learning recognised by the University;

(14) "recognised teacher" means a person working in any recognised institution or in any institution associated with the University and recognised by the University for the purpose of imparting instruction or conducting research or both and designated as recognised teacher by the ordinances;

(15) "statutes", "ordinances" and "regulations" means respectively, the statutes, ordinances and regulations of the University for the time being in force;

(16) "student" means a person who is admitted to a college and is born on the attendance register thereof until the end of the academic year;

(17) "teachers of the University" means Professors, leaders, Lecturers and such other persons as may be appointed for imparting instructions or conducting research in the University or in any college or in any institution maintained by the University and designated as teachers by the ordinances;

(18) "University" means Sri Krishnadevaraya University as constituted under this Act;

(19) "University area" means the area comprising the district of Anantapur;

(20) "University campus" means the area comprised within such limits of the headquarters of Sri Krishnadevaraya University as may, from time to time, be notified by the Government in the Andhra Pradesh Gazette;

(21) "University college" means a college established or maintained by the University and providing courses of study qualifying students for admission to University examinations in accordance with the regulations prescribed.

Section 3 - The University

(1) There shall be constituted in and for the area comprising the district of Anantapur, a University by the name of Sri Krishnadevaraya University which shall consist of a Chancellor, a Vice-Chancellor, a Rector, if any, a Senate, a Syndicate and an Academic Council.

(2) The headquarters of the University shall be at Anantapur and it may establish campuses at such other places within such limits of the headquarters as it may deem fit.

(3) (a) The University shall be a teaching University in the place of the Post-Graduate Centre at Anantapur declared autonomous under section 4 of the Andhra Pradesh Universities Acts (Supplementary) Act, 1976.1

(b) The University shall be a body corporate having perpetual succession and a common seal, and shall sue and be sued by the said corporate name.

    Section 4 - Objects

    The objects of the University shall be to disseminate and advance knowledge, wisdom and understanding by providing instructional and research facilities in such branches of learning as it may deem fit and by the example and influence of its corporate life, and in particular, to make special provisions for integrated courses in the humanities and sciences in the educational programmes of the University and to take appropriate measures for promoting inter-disciplinary studies and research in the University.

    Section 5 - Powers and functions of the University

    (1) The University shall have the following powers and functions namely:--

    (i) to provide for instruction in such branches of learning as the University may from time to time determine and to make provision for research and for the advancement and dissemination of knowledge;

    (ii) to grant, subject to such conditions as the University may determine, diplomas or certificates to and confer degrees and other academic distinctions on the basis of examinations, evaluation or any other method of testing on, persons, and to withdraw any such diplomas, certificates, degrees or other academic distinctions for good and sufficient cause;

    (iii) to organise and to undertake extramural studies and extension services;

    (iv) to confer honorary degrees or other distinctions in the manner prescribed by the statutes;

    (v) to provide instruction, for such courses of study, including the course of study by correspondence, to such persons as are not members of the University, as it may determine;

    (vi) to institute Professorships, Readerships, Lecturerships, Principalships, and other teaching or academic posts required by the University and to appoint persons to such Professorships, Readerships, Lecturer-ships, Principalships or other posts;

    (vii) to recognise an institution of higher learning for such purposes as the University may determine and to withdraw such recognition;

    (viii) to recognise persons working in any recognised institution or in any institution associated with the University for imparting instruction or supervising research or both, and to withdraw such recognition;

    (ix) to appoint persons working in any other University college, or institution or organisation as teachers of the University for a specified period;

    (x) to create administrative, ministerial and other posts and to make appointments thereto;

    (xi) to co-operate or collaborate or associate with any other University or authority or institution of higher learning in such manner, and for such purposes, as the University may determine;

    (xii) to establish such campuses, special centres, specialised laboratories or other units for research and construction as are, in the opinion of the University, necessary for the furtherance of its objects;

    (xiii) to institute and award fellowships, scholarships, studentships, medals and prizes;

    (xiv) to establish, maintain and manage colleges and hostels in the University campus, and to establish and maintain colleges, institutions and hostels in any part of the headquarters of the University;

    (xv) to make provision for research and advisory services and for that purpose to enter into such arrangements with other institutions or bodies as the University may deem necessary;

    (xvi) to declare a college, an institution or a department as an autonomous college or institution or department, as the case may be;

    (xvii) to determine standards for admission into the University which may include examination, evaluation or any other method of testing;

    (xviii) to demand and receive payment of fees and other charges;

    (xix) to supervise the residence of the students of the University and to make arrangements for promoting their health and general welfare;

    (xx) to make such special arrangements in respect of women students as the University may consider desirable;

    (xxi) to regulate and enforce discipline among the teachers and other employees and students of the University and take such disciplinary measures in this regard as may be deemed by the University to be necessary;

    (xxii) to make arrangements for promoting the health and general welfare of the teachers and other employees;

    (xxiii) to receive donations and to acquire, hold, manage and dispose of any property, moveable or immoveable, including trust and endowments properties for the purposes of the University;

    (xxiv) to borrow, with the prior written approval of the Government, on the security of the property of the University, moneys for the purpose of the University;

    (xxv) to institute and manage publication bureau, employment bureau, and University extension boards;

    (xxvi) to do all such other acts and things as may be necessary, incidental or conductive to the attainment of all or any of the objects of the University;

    (2) No college or institution associated with or recognised or maintained by any other University in the University area of this University shall be associated with or recognised by Sri Krishnadevaraya University for any purpose except with the prior approval of the Government and the concerned University and the management of the college or institution concerned.
