Background

  1. This petition emanates from the Commission's order in case no. CIC/AD/A/2012/000986 dated 19.6.12. The operative part of the Commission's order is given below:

    The Appellant stated that in the Delhi Lands Restrictions on Transfer Act 1972 there is no mention of NOC being required for transfer of land. According to him in his RTI application he had sought the copy of the order in which the NOC has been shown as a requirement for the sale deed in the Lal Dora Village since some SDM are insisting that such NOCs must be provided.

    The Commission on inspecting the Act noted that there is indeed no mention of any NOC in it.

    The Respondent at this stage stated that the required information can only be provided by the concerned three SDMs. The PIO is therefore directed to transfer the RTI application along with a copy of this order to each of the three SDMs directing each one of them to provide the order as sought in point 1 to the Appellant. In the event there is no order which stipulates that NOC is required for sale deed in land in Lal Dora Village the Appellant to be informed about the non requirement of NOC by each of the 3 SDMs. The information to be provided by 25th July 2012.
