1. Shri Jagdish V. Gursahani (Complainant) has filed a complaint dated 30.05.2011 before the Commission stating that the Respondents have failed to comply with the Commission's order dated 15.02.2011 in case No. CIC/SS/A/2010/001003. The operative part of the Commission's order reads as follows:

After hearing the Appellant, on perusal of the relevant document on file, the Commission deems it fit to direct the PIO, to furnish the details of records and the procedure followed in the destruction of records, within 15 days of receipt of this order.

A perusal of records shows that in compliance with the above directives of the Commission, the Respondents had sent a letter dated 26.04.2011 to the Commission stating as follows:

...As the records were pertaining to February 1990, which is more than 20 years old, the Security Department was unable to trace the same from their archives due to the destruction of records of 1990 log book entries.

You may please be aware that in July 2005, due to incessant rain/floods, various records kept in the Record Room near DM's office got destroyed, for which also no record is available. In view of this, compilation and collation of records was not just possible rendering out inability to adhere to the directives intimated in the above referred order.

2. The Complainant in his instant complaint-petition has contested the above statement of the Respondents and termed it as "false & frivolous". He has requested the Commission to "file FIR & fix responsibility of the present & past, including retired ones, of Air India, Bombay in relation to maintaining of the subject log book of Air India's aircraft VT-EFJ so that the order dt. 15-02-2011 in F. No. CIC/SS/A/2010/1003 can be complied with by Air India."

3. The Commission listed the above complaint for hearing on 25.04.2013 when the Respondents were present through Ms. Sarit Sharma, General Manager (Finance), Shri M.K. Ambedkar, Dy. G.M. (F), Shri J.N. Mankar, AGM-S, Shri K.L. Shastri, Officer Admin. And Shri Aioysivs Azaredn, Dy. Manager. The Complainant, however, chose not to be present for hearing.

4. During the hearing, the Respondents could not properly answer the queries posed to them by the Commission in relation to the instant matter. They had come totally unprepared for hearing. The Commission, therefore, asked them to file a written submission in the present matter.
