1. Shri B. Suresh hereinafter called the Appellant has filed the present appeal dated 04.12.2012 before the Commission against the Respondent namely Ministry of Shipping, Delhi. The Appellant was not present in the hearing whereas from the Respondent side PIO-Shri Ashwani Kumar (Director), Shri Anil Kumar Singh (SO), Shri Pankaj Batra (Government Counsel to CPIO) and Shri C.B. Singh (Advisor) were present in the hearing. The Appellant through the RTI application dated 18.07.2012 sought information regarding action taken and the present status two Representations filed by him on 1.02.2012 and 20.04.2012 respectively in the office of the Respondent.

2. CPIO vide letter no: I.35019/35/2012-Estt.-II dated 25.07.2012 replied to the Appellant. The RTI application of the Appellant was returned back to the Appellant with the request to send requisite fees. It was also mentioned that the time period of 30 days would be counted only after receipt of valid fee. After this, Appellant deposited the requisite fee of Rs. 10/- on 30.07.2012. After receiving the requisite fee, the CPIO vide his letter dated 24.08.2012 replied to the Appellant as follows:" Both of your representations have been examined along with your representation dated 11.07.2011 forwarded by Shri K. Muraleedharan, MLA on 1.08.2011 to Hon'ble Minister of Shipping in consultation with Andaman Lakshadweep Harbour Works (ALHW). After detailed scrutiny of the facts on record, the Competent Authority rejected your requests for reinstatement in service as completely devoid of merit. Shri K. Muraleedharan, MLA was appropriately informed of the position."
