  1. Heard the learned counsel for both the parties.

  2. As per Annexure A-2 order dated 06.10.2016, the applicant who is shown at serial No.12 working at CE Bhopal Zone was transferred to CWE (Sub) Barrackpore as DCWE (Cont). He was to report to duty by 20th Nov.2016.

  3. The applicant contends that the representation (Annexure A-3) was given on 20th October 2016, and was rejected by the respondents. The learned counsel for the applicant contends that his wife is suffering from very serious ailments for which he had produced some medical records. He also contends that he has not been relieved from duty from the present station.

  4. Learned counsel for the respondents opposes that submission. It is not sure whether the applicant was relieved by the department as stated by the learned counsel for the applicant. The applicant was to report for duty at the station to which he was transferred by 20.11.2016. If not joined there, the applicant must have been allowed to continue in the present station itself for nearly five months.
