Abstrak

Adanya hubungan hukum antara perus ahaan penyedia jasa pengiriman barang Pos Express dengan masyarakat peng guna
jasa tersebut, maka terjadi suatu perikatan antara pihak yang satu dengan pihak yang lain.yang didasarkan oleh adanya
perjanjian antara PT. Pos Indonesi a (Persero) dengan Konsumen. Selain itu, masing-masing pihak juga memiliki hak dan
kewajiban, yang harus di penuhi. Metode penelitian yang digunakan dalam penelitian ini adalah penelitian kuali tatif dan
jenis penelitian deskriptif dengan pendekatan yuridis-sosiologis. Sedangkan met ode pengumpulan data yang digunakan dalam
penelitian adalah metode wawancara, observasi, dokumentasi, peneli tian kepustakaan. Tekn ik pengolahan keabsahan data
menggunakan Trianggulasi. Metode analisis dat a yang digunakan dalam penelitian i ni adalah pengumpulan data, reduksi
data, penyajian data, penarikan kesimpulan. Hasil dan pembahasan d ari penelitian in i adalah (1) Hambatan yang terjadi
dalam penyelenggaraan jasa pengiriman barang ada tiga, dari pihak PT. Pos Indonesia (Persero) s elaku Pelaku Usaha yaitu
kelalaian dari karyawan dan akibat kesalahan teknis dalam transportasi dan teknologi, dari pihak Konsumen yaitu adanya
Konsumen yang kurang beritikad baik dan hambatan lain sepe rti alamat yang tidak jelas serta tumpang tindih antara
peraturan perundang-undangan yang satu deng an yang lain. (2) Perlindungan terhadap Pelaku Usaha atas tindakan
Konsumen pengguna jasa pen giriman barang yang tidak beritikad baik yaitu terdapat dalam Undang-Undang Nomor 38
Tahun 2009 tentang Pos dan Undang-Undang Nomor 8 Tahun 1 999 tentang Perlindungan Konsumen serta Resi dan SOP
pengiriman barang. Payung hukum sudah mengatur tetapi masih memungkinkan terjadinya sengketa antara Pelaku Usaha
dalam hal ini PT. Pos Indonesia (Persero) dengan Konsumen.. Karena payung hukum hanya memberikan perlindungan
secara represif, sedangkan bentuk perlindungan preventif akan mampu memberikan perlindungan ta npa harus adanya
sengketa. Saran dari hasil penelitian dan pembahasan adalah (1) Seharusnya Kons umen secara jujur dan terbuka pada saat
transaksi pengiriman bar ang. (2) Adanya mekanisme/prosedur pengiriman barang yang melindungi para pihak sebagai
bentuk tindakan preventif sebelum terjadi sen gketa. Semisal pembungkusan barang ditempat atau pada s aat transaksi
pengiriman barang dihadapan petugas kantor Pos.

The law correlation between goods shipping service company Pos Express and the consumers made a bond between them. Th e
base of this bond was th e agreement between PT Pos Indonesia with the consumers where they had rights and obligations that
should be obeyed. The research method which was used in this research was descriptive qualitative research by u sing juridical-
sociological. The method of collecting data which was used were interview, observation, docu mentation, and literature research.
The technique of data validation test was Trianggulation. The t echnique of analyzing data were data collecting, data educ tion,
data presentation, and conclu sion drawing. The result and discussion of this research wer e (1) There were 3 obst acles occurred
in carrying out the goods shi pping service: from PT Pos Indonesia (Persero), they were employees derel iction and technical
problem in transportation and technology; from the consumers, there we re some custo mers with bad behaviour, unclear
address, and also another unc lear rules. (2) the protection toward bussiness doer upon consumers’ bad behaviour of goods
shipping service was UU no.38 year 2009 about Postage and also UU no.8 year 1999 about consumer protection, receipt,
goods shipping SOP. S ome legal dispute between bussiness doer and the consumer, in this case PT Pos Indonesia with its
consumer, keep rising although some rules applied. This rule gives some repressive protection instead of preventive which could
give some protection without any legal di spute. The suggestion the writer can give are (1) Con sumer should be honest and open
in the shipping transaction. (2) There should be an agreement of goods shipping which protect the parties as a preven tive action
of legal dispute like by the time package system or when goods shipping transactionn g .
