National Green Tribunal (Financial and Administrative Powers) Rules, 2011

G.S.R.295(E)-- In exercise of the powers conferredby Section 13 read with clause (1) of sub-section (2) of Section 35 of the National Green Tribunal Act, 2010 (19 of 2010), the Central Government hereby makes the following rules, namely:--

1. Short title and commencement.--

(1)These rules may be called the National Green Tribunal (Financial and Administrative Powers) Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.-- (1) In these rules, unless the context otherwise requires.--

(a) "Act" means the National Green Tribunal Act, 2010 (19 of 2010);

(b) "Chairperson" means the Chairperson of the Tribunal;

(c) "Tribunal" means the National Green Tribunal established under Section 3 of the Act.

(2) The words and expression used in these rules but not defined herein and defined in the Act shall have the same meanings, respectively, assigned to them in the Act.

3. Powers of Chairperson related to posting or transfer of a Member.---(1) The Chairperson shall have the power to post a Member at a particular ordinary place' of sitting of the Tribunal.

(2) The Chairperson, depending on the contingency, shall have the power to transfer any Member from one ordinary place of sitting to another place of sitting by a speaking order.

4. Financial and Administrative Powers of Chairperson.--The Chairperson shall have the same powers as are conferred on a Head of the Department of the Central Gov9nunent in respect of the Delegation of Financial Power Rules, 1978, the General Financial Rules, 1963, the Fundamental and Supplementary Rules, the Central Civil Services (Leave) Rules, 1972, the Central Civil Services (Joining Time) Rules, 1979, the Central Civil Services (Conduct) Rules, 1964, the Central Civil Service (Classification, Control and Appeal) Rules, 1965, and the General...
