Petitioners impugn order dated 03.01.2019, whereby the Leave to defend application of the petitioner has been dismissed by the Controller and an eviction order passed.

Respondent had filed the subject eviction petition seeking eviction of the petitioners on the ground of bonafide necessity un Section 14(1) (e) of Delhi Rent Control Act, 1958 from the tenanted premises being part of property bearing no. 100, Bangla Sahib Marg, New Delhi comprising of a shop with verandah facing Bangla
Marg, New Delhi together with Godown and store etc., particularly as shown in red colour in the site plan attached to eviction petition.

Learned counsel for the petitioner under instructions petitioner no. 2 – Sushil Kumar Munjal, who is the sole proprietor Petitioner No. 1 and is present in Court in person, seeks leave withdraw the petition.

Petitioner who is present in Court in person, undertakes that shall vacate and handover the peaceful vacant possession of tenanted premises to the respondent on or before 31.05.2020. It contended that use and occupation charges, etc. have been settled between the parties.
