Karnataka Selection of Candidates for Admission to Government Seats in Professional Educational Institutions (Amendment) Rules, 2012

In exercise of the powers conferred by sub-section (1) of Section 14 of the Karnataka Educational Institutions (Prohibition of Capitation Fee) Act, 1984 (Karnataka Act 37 of 1984), the Government of Karnataka hereby makes the following rules further to amend the Karnataka Selection of Candidates for Admission to Government Seats in Professional Educational Institutions Rules, 2006, namely.-

1. Title and commencement.-

(1) These rules may be called the Karnataka Selection of Candidates for Admission to Government Seats in Professional Educational Institutions (Amendment) Rules, 2012.

(2) They shall come into force from the date of their publication in the Official Gazette.

2. Amendment of Rule 2.- In the Karnataka Selection of Candidates for Admission to Government Seats in Professional Educational Institutions Rules, 2006 (hereinafter referred to as the 'said rules'), in Rule 2.-

(i) for clause (a), the following shall be substituted, namely.-

"(a) "Admission Centre" means a center, called the Karnataka Examinations Authority, where allotment of seats to Professional Courses is done by centralised counseling through on line on the basis of merit subject to reservation policy of the Government after obtaining the priority options from the candidates to the Government seats as may be notified by the Government from time to time";

(ii) after clause (a), the following shall be inserted, namely.-

"(aa) "Application Form" means the application form issued by the Karnataka Examination Authority along with brochure in which the candidate may apply for Common Entrance Test along with other details of his study from 1st to 12th Standard";

(iii) in clause (c), after the words "as per their academic eligibility", the words "and other conditions specified in these rules" shall be inserted;

(iv) in clause (l), after the words "and includes seats surrendered by private management notified by the Government as Government seats", the words "includes any other seats as may be notified by the Government from time to time" shall be inserted;

(v) after clause (l), the following shall be inserted, namely.-

"(ll) "Helpline Centre" means regional centers of the Karnataka Examination Authority at such places as may be authorised and notified by the Karnataka Examination Authority where the candidate may come for document verification, online keying of options, counseling and allotment of seats, payment of fees and issue of admission order";.

(vi) after dause (r), the following shall be inserted, namely,-

"(rr) "Pool" means pool of Government seats and includes seats cancelled, forfeited, newly added, and seats surrendered by private management and students".

3. Amendment of Rule 3.-In Rule 3 of the said rules.-

(i) In sub-rule (4), in second proviso to sub-clause (c), for the words "Urban Agglomeration of the city", the words, figures and letters "15 KM from the Bruhat Bangalore Mahanagara Palike Limits in respect of city of Bangalore or limits of the City Corporation in case of other City Corporations" shall be substituted.

4. Amendment of Rule 5.- In Rule 5 of the said rules, in sub-rule (1).-

(i) In sub-clause (iii) and sub-clause (iv), after the words "read and write Kannada", the following shall be inserted, namely.-

"and must have secured not less than 12 marks out of 50 marks prescribed for Kannada Language Test of 4th Standard".

(ii) In sub-clause (vi), for the words "Record Office of the Defence Unit of Army/Air force/Navy where the Parent's service record are maintained", the following shall be substituted, namely.-

"respective branch of integrated HQ of Ministry of Defence for officers and respective Record Offices for JCOs/OR".

(iii) After clause (xiv), the following shall be inserted, namely.-

"(xv) whose parent is serving in Central Armed Police Force service, who at the time of joining the CAPF service had declared the hometown as a place in the State of Karnataka, proof of such domicile having been produced by obtaining the extract from the Record Office of the CAPF Unit where the Parent's service record are maintained".

5. Amendment of Rule 7.- In Rule 7 of the said rules, in sub-rule (4), after the words "along with the application", the following shall be inserted, namely.-

"All information mentioned by the candidate in the application form on the date of application including annual income or caste and category shall be final and no change shall be allowed at any stage under any circumstances thereafter".

6. Amendment of Rule 10.-For Rule 10 of the said rules, the following shall be substituted, namely.-

"10. Verification of documents and exercising of options for allotment of Government seats.-(1) Verification of Documents.-

(i) After the publication of results, the Karnataka Examination Authority shall notify helpline centres at District Headquarters or any other places as it deems necessary and shall establish the same for verification of documents online keying of options, counseling and allotment of seats, payment of fee and issue of admission order of eligible candidates.

(ii) The candidate shall produce the specified original documents along with photocopies thereof. The Executive Director shall cause verification of documents at each help line centres as per the time schedule notified for verification of documents based on the rank of the candidates. The candidates shall appear at the helpline center as per time schedule on the notified dates with all originals along with two set of photocopies of required documents. One set of photocopies of the required documents shall be retained with respective helpline centers and the originals shall be returned to the candidate and enter all the details of the candidate's data online into the system which is linked to the Karnataka Examination Authority server. Verification of documents for all the disciplines shall be carried out at once by the Karnataka Examination Authority and candidate shall be issued with verification slip signed by the Verification Officer by mentioning all the details of the candidates including merit, rank, course of discipline, category, special category, if any, to which the candidate is eligible.

(iii) The candidate seeking allotment of Reserved Category Seat under sub-rule (2) of Rule 9 shall not be considered for allotment of seats unless the candidate produces a Caste Certificate in Form 'D' in case of candidate belonging to Scheduled Castes and Scheduled Tribes and in Form 'E' in case of candidates belonging to Category I and a Caste Income Certificate in Form 'F' for Other Backward Classes like II-A, II-B, III-A and III-B, issued by the jurisdictional Tahsildar, in accordance with the Government Order No. Sa Ka E 225 BCA 2002, dated 30th March, 2002 and Notification No. Sa Ka E 104 BCA 2011, dated 6-2-2012 as amended from time to time:
