1. The Commission has received a Complaint petition; dated 26 February 2013 (Dy. No.: 109637/2013) from Dr. Gian Singh, New Delhi stating that he has not received any information from the concerned PIO in respect of his RTI application dated 22 October 2012 submitted to the PIO, Divisional Commissioner Office, GNCT, Delhi, this was later on transferred to the PIO/SDM, Kalkaji, GNCT, Delhi; again it was transferred to the SDM, Saket. A copy of the complaint and RTI application are enclosed. In exercise of the powers vested under Section 18(1) of the Right to Information (RTI) Act, the Commission directs the Appellate Authority to enquire into the allegations made by the Complainant and to pass an appropriate order with a view to ensuring that the desired information is provided to the Complainant, at the earliest.

2. The Appellate Authority is also directed to obtain the explanation of the PIO in writing for not furnishing information to the appellant which is a statutory requirement under the RTI Act and to forward the same to the Commission along with his comments within 3 weeks of receipt of the Order to decide on the imposition of penalty on the concerned persons in terms of Section 20(1) of the Right to Information (RTI) Act.
