Decision: Shailesh Gandhi, Information Commissioner Facts arising from the Complaint: 1. Mr. Kuldeep Singh Yadav had filed a RTI application dated 11/07/2011 with the PIO, MCD, Rohini Zone asking for certain information. Since no reply was received within the mandated time period of 30 days, the Complainant filed a Complaint under Section 18 of the RTI Act with the Commission. On this basis, the Commission issued a notice directing the PIO, MCD, Rohini Zone on 06/09/2011 to provide information to the Complainant and further sought an explanation for not furnishing the information within the mandated time. 2. Subsequently, the Commission received a copy of the letter dated 07/10/2011 from the, PIO & Assistant Commissioner wherein, it has been stated that the RTI Application dated 11/07/2011 was not received in his office. However he received the said RTI application only with the Commission's notice dated 06/09/2011. In compliance of the Commission's direction dated 06/09/2011 a reply was sent to the Complainant on 07/10/2011. Further with regard to query no. 1 it was stated that since the information was related to the Engineering Department, the RTI application was forwaeded to the deemed PIO & EE-(M) III on 26/09/2011 through PIO SE-II. Further with regard to query no. (2) it was stated that the information sought relates to the Pension Ward no. 40 and the Complainant may come and inspect the records within one week with prior intimation to the Department on any working day as the information... |
