Facts arising from the Complaint:

1. Mr. Chander Dev Meena filed an RTI application with the PIO (HQ), MCD, Education Department, Delhi on 24/03/2011 asking for certain information. Subsequently, the same was transferred to the PIO, MCD, City Zone on 31/03/2011. However on not having received the information within the mandated time, a Complaint was filed under Section 18 of the RTI Act with the Commission. On this basis, the Commission issued a notice to the PIO/ AC, MCD, City Zone, New Delhi on 18/07/2011 with a direction to provide the information to the Complainant and further sought an explanation for not furnishing the information within the mandated time.

2. The Commission received a letter dated 03/08/2011 of the Additional Director (Education-I), MCD (HQ), Delhi wherein it has been stated that the Complainant filed the RTI application at CSB Center, City Zone. Further, after a number of subsequent transfers; the RTI Application was transferred to Deputy Director of Education, Central Zone on 06/05/2011 for necessary action. However, the Commission has neither received a copy of the information sent to the Complainant nor has it received any communication to this effect from the DDE (Central Zone). The Commission also received a letter dated 23/08/2011 from the Complainant wherein he has alleged that no information has been provided to the Complainant till date.

Decision:

3. The Complaint is allowed.

4. In view of the aforesaid, the Respondent PIO/Deputy Director of Education, MCD, Central Zone is hereby directed to provide complete and correct information with regard to the RTI Application dated 24/03/2011 to the Complainant before 01/12/2011 with a copy to the Commission.
