FACTS

1. The matter is heard today dated 18.3.2011. Appellant present. The Army is represented by Col. A. K. Vyas.

2. The matter, in short, is that vide RTI application dated 15.2.2009, the Appellant had sought the following information from the CPIO.

(a) number of incidents involving allegations of corruption/ financial irregularity (in any form) against officers of Indian Army (Colonel and above only) that came to notice between the period January 2001 to till date.

(b) In how many cases (out of above) prosecution was instituted/ to be instituted.

(c) In how many cases (out of A) Departmental proceedings were institute/d to be instituted.

(d) how many cases (out of a) were closed after preliminary inquiry without issuing chargesheet to alleged officers i.e. officers were not found guilty by the department.

(e) Copies of all such chargesheets/ final orders/ notings (i.e. all documents) in cases of ''C'' and ''D'' as above may be provided under RTI Act (excluding those matters which are pending.

This information was sought from January 2001 onwards.
