1. The Appellant was represented by Shri S.K. Tuteja and Shri Jagdish Kalra.

On behalf of the Respondent, the following were present:

(i) Shri M.K. Prasad, AGM (Law),

(ii) Shri Anil Sood, CM (Law)

2. In this case, the Appellant had, in its application dated 8 July 2009, requested the CPIO for a few information regarding the clearing of a number of cheques. The CPIO provided the information in his reply dated 27 July 2009. Not satisfied, the Appellant preferred an appeal on 6 August 2009. The Appellate Authority disposed of the appeal in his order dated 15 September 2009 and endorsed the reply given by the CPIO. Still not satisfied, the Appellant has approached the CIC in second appeal.

3. Both the parties were present during the hearing and made their submissions. The Appellant submitted that contrary to what the CPIO had claimed about the date(s) of dispatch of the cheques for collection, they were actually dispatched much later. The Respondents submitted that the branch no longer had the relevant records in its possession to show the exact date of dispatch.
