1. This matter pertains to an RTI application dated 14.2.2012 filed by the Complainant, seeking information on four points pertaining to a case decided by Rent Control and Eviction Officer. The Complainant lodged a complaint with the Commission vide his letter dated 13.4.2012 under Section 18(1) (c) of the RTI Act.

2. The Complainant was not present in spite of a written notice having been sent to him. He has sent us a letter dated 27.5.2014, stating that he would not be able to attend today's hearing. In this letter, he has further stated that the information has been sought in a particular context, where the Respondents are occupying a prime property in the heart of Allahabad town without paying rent. He has further stated that even after a reasonable rent was decided by the Rent Control and Eviction Officer, the Respondents continue to litigate in the matter. The Complainant has prayed for a direction by the Commission to the Respondents to provide the requested for information to him. He has also prayed for imposition of penalties and cost upon the Respondents.

3. The Respondents submitted during the hearing that the RTI application dated 14.2.2012 was replied by the CPIO vide his letter dated 12.3.2012. They have shown us a copy of this letter and have stated that they would send another copy of the same to the Complainant.

4. In the above context, we also note the following observations of the High Court of Delhi in its judgment dated 28.10.2013 in J K Mittal vs. Central Information Commission and Anr., WP (C) No. 6755/2012:-
