Mr. D Saikia, learned Senior Additional Advocate General, Assam, assisted by Mr. B Choudhury, learned Government Advocate for Respondent Nos.1 and 2, Mr. N Borah, learned Standing Counsel for Assam State Election Commission and Mr. J Chutia, learned Standing Counsel for Respondent No.4.

I n the present Public I nterest Litigation, main prayer of the petitioners is that respondent-authorities be directed to hold election of Karbi Anglong Autonomous Council (in short ‘Council’).

Admittedly, the last general election of the Council was held on 9.1.2012. The term of the elected Council was 5 years and the period of the elected Council expired on 12.1.2017. But, vide notification dated 9.1.2017 issued by Respondent No.2, the term of Council has been extended for a period of 6 months.

The apprehension of the petitioners is that respondent-authorities might further extend the term of Council, instead of holding the election within the extended term of Council.
