Mr.R Dhar, learned Additional Senior Government Advocate, assisted by Ms.B Phom, learned counsel for Respondent No.5.

This intra court appeal is directed against the order dated

11.9.2017 passed by the learned Single Judge of this High Court, whereby he has dismissed appellant’s WP(C) No.218(K) of 2016.

The whole dispute is whether the new Polytechnic I nstitute under the Central Scheme Project should be set up at Yongnyah or at Hukphang or Orangkong.

The State of Nagaland originally approved the site at Yongnyah for setting up the Polytechnic I nstitute. But since certain section of public agitated against the approved site, the State Government constituted an I ndependent Committee to examine the matter of selection of site for the I nstitute. The Committee examined the approved site along with certain other sites and reported that new site either at Hukphang or Orangkong may be considered for setting up the I nstitute. However, the Committee, in its report, nowhere stated that the already approved site at Yongnyah was unsuitable for the Polytechnic I nstitute. I n fact, the Committee was expected to give a finding after site verification whether the approved site at Longnyah was suitable or not, but it did not do so.
