Respondent is a consumer of the Petitioner. He applied for shifting of the meter. Petitioner created a demand of Rs.20,701/- for shifting of the meter on 4.1.2008. Respondent deposited the said amount. Respondent filed the complaint with the grievance that in spite of making the payment as per demand raised by the petitioner, the petitioner did not shift the meter and instead issued a letter dated 24.11.2008 directing the respondent to contact Deputy Manager, Loss Control Cell for settlement of the outstanding dues standing in the name of Prahlad Kumar Gupta. The version of the complainant is that he has no connection with the said P.K. Gupta. He requested the petitioner to shift the meter but the petitioner did not pay any heed to his request.

Petitioner, on being served, filed its written statement taking the stand that since the respondent had not cleared the outstanding dues of P.K. Gupta, the meter could not be shifted.

District Forum allowed the complaint and directed the petitioner to shift the meter of the respondent in terms of the Electricity Act. Rs.10,000/- were awarded as compensation to be paid within 30 days failing which the amount was to carry interest @ 10% per annum.

Petitioner, being aggrieved, filed the appeal before the State Commission, which dismissed the same.

Notice sent to the respondent was received back with postal remarks "not known". Counsel for the petitioner was directed to ascertain the fresh/correct address of the respondent and file the same within 2 weeks. On furnishing of the correct address, office was directed to issue Notice...
