This revision petition is directed against the order of the State Commission dated 26.08.2015 whereby the State Commission declined to condone the delay in filing the appeal of the petitioner against the order of the District Forum. The learned counsel for the petitioner states that they came to know of the order of the District Forum only on 08.03.2015, the appeal was filed on 21.04.2015 and there is no documentary proof of the petitioner company which was served prior to the date aforesaid date. Considering all the facts and circumstances of the case, the revision petition is allowed and the impugned order is set aside subject to payment of `10,000/- as cost to the complainant/respondent. Subject to the payment of the cost, the State Commission shall proceed to decide the appeal filed by the petitioner on merits.
