This Revision Petition is directed against order dated 25.1.2014 passed by the Chhattisgarh State Consumer Disputes Redressal Commission, Pandri, Raipur (for short "the State Commission") in FA/13/563. By the impugned order, the State Commission has dismissed the Appeal preferred by the Petitioners/Complainants against the order dated 17.6.2013, passed by the District Consumer Disputes Redressal Forum, Raigarh (for short "the District Forum") in Complaint No.23/2013, as barred by limitation. By the said order, Petitioner No.1 was directed to refund to the Complainant, Respondent No.1 herein, a sum of Rs.90,000/- charged from him for carrying out repairs in the vehicle, though these were within the warranty period of one year, along with a sum of Rs.10,000/- as compensation for financial and mental harassment and Rs.2,000/- towards costs.

It is pointed out by the office that there is a delay of 118 days in filing the Revision Petition. In the application seeking condonation of the said delay, the explanation furnished is as follows:

The certified copy of the impugned order was issued to counsel for the petitioner on 29.1.2014. The advocate sent the same to the petitioner''s office and received by petitioner on 3.2.2014. After received the same, the petitioner sent the same to Divisional Manager (Legal), M/s Tata Motors at Thane, Maharashtra whereby it was opined in third week of March 2014; to challenge the same before Hon''ble National Commission. Having regard to the same, the petitioner approached Ms. Annapurna Tiwari Advocate at Bilaspur for drafting of the same and finding a suitable practicing advocate in Delhi. On 15th April, the documents and case file were handed over to the counsel for the petitioner for preparation of Revision Petition.
