  1. Applicants through this OA have sought quashing of the decision of the respondents whereby their eligibility for selection to the post of Loco Inspector was excluded. Consideration for promotion is the relief claimed.

  2. A person on stationary post without three years; continuous experience as mail/passenger/goods train with footplate experience has been found to be ineligible for the post of Loco Inspector. On the other hand, decision of the Tribunal on an identical issue where Diesel Assistant/Fireman Grade 'A' on stationary posts allowed exemption from footplate experience for consideration for promotion. The decision of the Tribunal as to lack of footplate experience not being an impediment for promotion as Loco Inspector was affirmed in Writ Petition (Civil) No.8515-17/2006 in Union of India v. Rakesh Kumar, decided on 21.8.2007. Learned counsel of applicants would seek extension of the benefit.

  3. Though none appeared for the respondents, even on the second call, yet their reply is considered. They are proceeded under Rule 16 of the Central Administrative Tribunal (Procedure) Rules, 1987. The plea of the respondents in their reply is that as the applicants do not have three years' footplate experience...
