Dispute between the parties as is reflected in the order dated 14th August, 2008, is with regard to rate of interest and the period from which it is to be paid. It is not in dispute that Surveyor in its report dated 13th March, 2005 assessed the net loss at Rs. 1,7,923/-. It is also not in dispute that interest @ 12% per annum has been awarded to the respondent by the District Forum from the date of filing of complaint which was instituted on 4th January, 2006.
