Author Vikram Seth is one of the first public figures to have come out of the closet in India. He was also instrumental in drafting a petition against Section 377 of the Indian Penal Code which decriminalises homosexuality. As his publishers Penguin announced his next work, A Suitable Girl, for publication in 2013, he sat down and answered some questions on what the Delhi High Court judgement means.
What do you think of the Delhi High Court judgement? Has it gone far enough? What does it lack? What needs to be done? How significant is this?I think it an excellent judgement, calm, lucid, well-structured and not obviously amenable to successful appeal or challenge. It has gone far enough; some provisions of Section 377 relating to coercion or child protection had to be retained. In some respects, such as its finding that the law as it existed contravened Article 15, it went further than many expected. The judgement doesn't lack anything as such.
